Selling a tenant-occupied property

A tenant’s home remains their home while a property is for sale. Begin with the lease and a practical access plan, then decide how to present the property and what possession terms can accurately be offered.

Read the lease before setting the schedule

Gather the signed lease, extensions, amendments and any separate agreements. Identify the current term, renewal provisions and language addressing access. Ask a Texas attorney to resolve legal questions before notices are sent or possession is promised.

Coordinate the proposed sale plan with the person responsible for managing the tenancy. Conflicting instructions about entry, repairs or payments can create avoidable confusion. Keep responsibilities clear between the owner, property manager, listing brokerage and closing provider.

Plan showings and marketing around occupancy

Discuss the notice and scheduling process that fits the lease and applicable requirements. Address pets, alarms, keys and the tenant’s belongings before photographers, inspectors or buyers visit. Any arrangements with the tenant should be documented appropriately.

Keep private information out of marketing materials. Rental documents shared with prospective buyers should be handled through an appropriate process with unnecessary personal information removed. Publicly advertising a tenant’s financial or personal details does not help explain the property.

Make the transfer understandable

The buyer needs accurate information about lease obligations and balances. Reconcile the rent ledger, deposits and any concessions before closing. Texas Property Code section 92.105 addresses deposit responsibility after an ownership change, including an acknowledgment from the new owner. Ask the closing provider and legal adviser how the applicable requirements will be completed.

Confirm who will notify the tenant of the ownership change, where future payments go and who handles maintenance after transfer. A sale plan should cover the first day under new ownership as well as the signing appointment.

  • List all occupants and leases in the transaction file through an appropriate private process.
  • Confirm what documents and funds will transfer.
  • Reconcile repairs already promised and work still in progress.
  • Do not advertise vacant possession until it can be supported.

Common questions

Can a buyer move in immediately after closing?

Only if the existing agreements and the transaction allow it. Have possession reviewed before accepting an offer that assumes the property will be vacant.

Can I offer the tenant an incentive to cooperate or move?

Any proposal should be voluntary, lawful and properly documented. Obtain legal advice on terms and consequences before making an agreement.

Will Kolibri communicate directly with my tenant?

Agree on responsibilities first, especially when another manager is involved. No contact plan or service cadence is assumed until the scope is confirmed.
